And so, we are almost at the end of our sixth VC’s tenure. Professor Mark E Smith, CBE (as of a few weeks ago), perhaps has not quite lived up to the rock star credentials of his namesake. He made a strong start and endeared himself to large parts of the University community by scrapping two schemes overseen by the previous incumbent, namely the proposed (or threatened) merger with the University of Liverpool, and the dreaded Business Processes Review (BPR). He is well-liked by many senior staff at the University, and courteous and relatively even-handed in many interactions with the University community. In talks to wider groups, he has a tendency to focus on detail and technicalities, particularly for contentious issues (see report on the VC all-staff meeting, in this issue). And he has amused some colleagues with a few verbal quirks, using characteristic metaphors such as ‘taking the temperature of the room’ at Senate to decide what Senators wished to do (some of whom might have preferred to be given the opportunity to vote on issues, rather than have their will interpreted in this way).

Relations with staff seemed to sour considerably at the start of the ongoing pensions crisis, where the VC looked rather disconnected and uncaring compared to other VCs, who not only made public statements of support for their staff, but in some cases even stood with them on the picket lines. When the VC did visit the Lancaster UCU picket line, he was dropped off by his driver in the University’s official Jaguar, and then proceeded to attempt to answer questions via megaphone, in his usual technical style. There was little sense of solidarity with staff, despite his claim that his own pension was also affected. He may have been put in a difficult position in this regard due to his role as the chair of UCEA, which represents employers’ interests, and his own substantial pay package.

Other developments during his tenure (see subtexts passim), including the Professional Services Project (the BPR by another name?), changing the Professional Development Reviews of old into a Performance and Development Review, the destruction of the University Court, the disempowering of Senate, the incidents involving bigoted material and behaviour among the University community, the realisation that we have a massive gender pay gap, and the increasing centralisation and managerialism that have crept into many the University’s structures and processes, will do little to leave good memories of his time here.

It may be that another VC would have done far less to arrest or at least slow the flood of utilitarian thinking and marketisation that afflicts the higher education sector, in the face of government policies that very explicitly push in this direction of travel. It is clear from the initial consultation of staff during the new VC’s recruitment process that many staff wish to find a new leader who will stand with staff and students against these trends, rather than attempting to explain them away. Despite this, it is likely that Mark Smith will be remembered as someone who worked hard for the University, and cared a great deal about his work – which is more than can be said about some VCs! We wish him and the staff and students of Southampton University the best of luck in their future endeavours.

 

STATE OF THE UNI

A moderately populated Great Hall played host to the final all-staff meeting on Tuesday 25 June, led by Vice-Chancellor Professor Mark E Smith, CBE, before his imminent departure to southerly climes. The majority of those present, apart from the conflagration of senior managers [is this the correct collective noun for senior managers? Readers are welcome to write in with alternative suggestions] that routinely accompanies the VC to such events, appeared to be Professional Services (PS) colleagues. Leaving aside the general reluctance of academic colleagues to turn up to such meetings, this may have been as much to do with it being exam board season as with concerns about the freeze, err, control on new recruitment, which affects only PS staff.

‘Let’s kick off’, said the VC, perhaps showing his enthusiasm for what may come to be regarded as one of the main legacies (or white elephants, perhaps) of his tenure, Lancaster’s very own football university. A little later, UA92 also got its own slide, and according to the VC everything is going swimmingly, with the first intake of students due to start in September and recruitment apparently very close to being on target. He was keen to stress, however, that UA92 had a very ‘different model’ for student recruitment, with multiple entry points for students, and that it definitely was not in any way comparable with the normal university recruitment cycle. It would of course be churlish to assume that this means that UA92 has in fact recruited very few students!

Before going sportsy though, the VC was keen to highlight the good news. Financially, the HE sector is in pretty good health, with Lancaster at the top of the distribution. The phrase ‘Expanding Excellence in England’, rather than applying to the VC’s feelings about his own emoluments, is the name of a Research England fund which will contribute £7.6m, alongside LU’s own £5.6m contribution, for the ‘Beyond Imagination’ project housed in LICA. There will be a new School of Architecture, with students starting their degrees from 2020. And there are a host of building initiatives on campus in progress or about to start, including the Health Innovation Campus, a £1m refurb of Edward Roberts Court, the LUMS Space Programme (he didn’t mention the multi-million pound stuff-up that delayed it in the first place), a £6m expansion of the Sports Centre, the Library Phase 3 (whether there will be any staff left to work there is another question he did not address), a 400 seat lecture theatre, an upgrade of our district heating system, and a refurb of Bailrigg House.

The VC claimed that these developments showed that the University was increasing its physical infrastructure at the same pace as increases in student numbers, and that the new lecture theatre provided physical proof that this was true. Staff who have had to teach after 6pm this year might wonder whether in fact this was true, or whether the new lecture theatre should in fact have been built a few years ago to prevent evening teaching in the first place. And staff who have been denied a regrade, or whose departments or units have had vacancies turned down might wonder if all this spending on making the campus look prettier could have been put to better use (more on this later).

The VC whizzed through a few other international developments – the new Leipzig venture will offer degrees in Business from later this year, and in Computer Science from 2020, and there will be a ‘Future Cities Research Institute’ jointly hosted by Lancaster with its long-standing partner in Malaysia, Sunway. And closer to home, he outlined the changes to the University’s senior leadership, most of which had already been shared via the news portal, with the addition that Professor Sharon Huttly’s Pro-VC role would expand to encompass responsibility for not only Education but also Equality, Diversity and Inclusion (EDI). This was a change from the previous plan, which was to have Stephen Decent look after EDI as part of the ‘people’ part of the Academic Development brief (which includes planning and resourcing). While the VC was keen to stress that all of the senior leadership had EDI as part of their brief, this move ‘created more bandwidth at senior level to work on EDI issues’. It will certainly be a welcome move for staff and students who have been campaigning on related issues to have EDI explicitly named in one of the Pro-VC titles, and with the greatest respect for Professor Decent, the optics of having yet another white man in charge of this portfolio were not great.

We have known since May that Professor Mandy Chetwynd would be retiring, and no doubt many subtext readers will wish her well and appreciate her long service to the University. What is not quite clear, which also came up in one of the questions to the VC, is what impact laying down the role of Provost for Student Experience, Colleges and the Library would have on… Colleges and the Library. Colleges in particular appear to have been under attack for a considerable period, with SCRs being closed, bars moving to central control, accommodation blocks spread around campus due to building work, and various college staff roles being reduced or centralised. It may be the case that this move represents the final nail in their coffin – until they are resurrected as nothing more than a convenient label for where students live in their first year.

The last substantive points in the VC’s speech, apart from a few warm words about the forthcoming graduation ceremonies, a reassurance (supposedly) that the Augar review could have been a lot worse, and a hurrah for our league table positions, were to do with the gender pay gap and the professional services freeze – sorry, vacancy control management. On the gender pay gap, the VC reported that there was reporting, reports, and engagement – but there seems to have been little actual action in the 15 months since Lancaster’s terrible pay gap statistics were first published. And this is hardly surprising, given that the expenditure on staff who have EDI work as their lead responsibility at Lancaster is considerably less than at many other HE institutions. And for the few roles we have, the pay also seems to be below par. Various reports are due to be published over the coming months (no doubt choosing to publish these in the summer when fewer staff and students are around is entirely accidental), so we will see what they contain.

On vacancy control, the VC followed his usual MO when faced with difficult questions, and retreated to technical details and graphs of figures showing the University’s adjusted net operating cashflow, where it was projected to be, and where we needed it to be in order not to get in to difficulties in future. But there was ‘no need to panic, absolutely a need to adjust the tiller’, he said, which may lead readers to wonder what icebergs lie ahead. The University faces no clear financial difficulties, apparently, but needs to be financially disciplined. How long this situation will continue, he said, depends on financial discipline. If student recruitment is strong, the period should be shorter. He was at pains to point out that it was not only Professional Services staff who were affected. The capital plan had already been adjusted – and no vacancy control would mean more adjustment. The consequences would be for example, not being able to address the longer teaching day (he did not mention that not having a prettier campus or not having a bigger sports centre are options). And, don’tchaknow, we’re all in this together: even the VC’s own office has had a vacancy turned down.

As the VC finished his remarks and turned to the questions submitted anonymously via the iLancaster app (human two-way interaction in the room is no longer desirable, apparently), it became clear that he had not, in fact reassured the University community on various issues. Numerous questions, a few submitted before he started speaking, but many during the session, related to the vacancy control. Others addressed UA92, paternity leave provision, the rumours of a closure of Religious Studies, advice for the new VC, neoliberalism in education, and why so few academics were present.

The VC gave a few convincing answers, but overall tended to deflect and refer back to his previous comments. Some of his answers may have given colleagues pause for thought. For instance, the idea that the vacancy controls required ‘imaginative thinking’ on behalf of managers in terms of how to address their staffing needs. No doubt many managers will be left imagining how their staff will cover the same (or higher) workloads with fewer people to do the work. The VC appeared to hint that in future there would also be controls (though he did not use this word) on academic recruitment, but that it was important to maintain staff-student ratios. And to a question about why PS staff were being targeted when there were some academics who apparently had not published or taught in years, the VC suggested this needed to be addressed through performance management, and that the new PDR process would allow this… and thus the seeds of division sown by this process seem to be bearing fruit already. One welcome clarification the VC provided was that maternity/parental leave cover should emphatically not be affected by vacancy control. Whether this message gets through to the people who have already knocked back requests for such cover (see letters, in this issue), or the managers who don’t even bother to apply in the first place because of the continuous pressure to find savings, remains to be seen.

EDITORIAL

In days gone by vice-chancellors used to boast about how many cranes their campus featured (see subtext 9). These days, their prevailing rally cry seems to be ‘It’s definitely not us’, as they rush to reassure their students, staff and other interested parties that they are not one of the three universities that is close to bankruptcy – perhaps because of the very cranes, and associated building projects.

Of the universities in the North West, one of which is allegedly in this unfortunate position, Bolton’s VC George E Holmes was quick off the mark to let people know how healthy his, er, his university’s finances were via the media, while our very own Mark E Smith (readers may wonder whether a middle name beginning with an ‘E’ is a prerequisite to be VC of a North-Western uni) chose to share the good news that it is someone else in his recent all-staff meeting. No doubt other VCs will follow, though there has thus far been a conspicuous silence from the University of Cumbria, which has been running at a loss according to the most recent set of accounts available on its website, and whose financial woes were highlighted by The Guardian as long ago as January (https://www.theguardian.com/education/2018/jan/30/fears-university-closures-office-for-students).

Among all these denials of bad fortune, there seem to be few VCs willing to stick their necks out and talk about what a colossally stupid idea it is to run universities as if they were part of a market, and treat education as a tradeable commodity like cheese. If a university were allowed to close because of bankruptcy, a number of media sources have pointed out this would have a huge impact not only on current students, but would also lead to hundreds if not thousands of job losses, and – for universities in smaller towns or cities – could devastate the local economy. The tarnished reputation of degrees from a failed university may also impact on the government’s favourite indicator of HE success, namely employability. While it seems unlikely that the university sector will somehow reverse the relentless onslaught of marketisation, perhaps one or more bankruptcies and the subsequent mess may be just the wake-up call we need to change course. Just as long as it’s definitely not us!

SENATE REPORT

It was a somewhat subdued Vice-Chancellor who opened Senate with his usual verbal report, and it is fair to say that he had much to be subdued about. There was the small matter of Lancaster’s rather large gender pay gap – one of the highest in the HE sector and not a league position he relished. He did not want to speculate on what might have caused this (though management policies and practices might be a good place to start). He was instead in the process of setting up a Task Force to look into this, with membership and terms of reference were being finalised. But we should not expect immediate results and it was likely to take ‘years of activity’ before the situation was resolved (so don’t hold your breath, laydeez).

He mentioned the recent pensions strikes (the most effective and best-supported that UCU had ever mounted, though of course he didn’t say this). He wanted to express his thanks for how the action was conducted to all involved, to Lancaster UCU, to heads of departments, and to the students. We all behaved magnificently, it would appear. As to the pensions issue itself, employers and union were now united in trying to ‘shift the goal posts’ (he wasn’t saying this the last time Senate met). On the plus side, he was happy to report a major improvement in the student retention rate, something he had previously identified as a major concern for the university. There was also to report a successful bid for an additional 60 medical student places, and a move from 9th to 8th place in The Times Complete University Guide.

There followed a discussion and approval of an Intellectual Property Strategy, content embargoed so we can’t report it. Then came a further look at proposed amendments to Charter and Statutes. As reported in subtext 174, Senate at its last meeting had relinquished its right of veto over Statute changes but had asked Council to look again at its proposals to ensure that Senate was at least consulted before changes were made relating to academic matters and student welfare. With the assistance of Professor Alisdair Gillespie of the Law School, a form of words was found that required Council to ‘give consideration’ to the views of Senate before making future changes. This, suggested Professor Gillespie, was the next best thing in the absence of a veto. The amendments were generally welcomed, though one senator pointed out that Council could still override the wishes of Senate if it was minded to do so. He believed that the result of all these changes gave too much power to Council and, with the abolition of Court, there was now no constitutional restraint on its actions. His, though, was very much a minority view and Senate voted overwhelmingly for the Statute changes.

Then came reports on University KPIs, and on revised arrangements for the conferral of PhDs (see below). Finally, approval was given to the new title of the Department of Entrepreneurship, Strategy and Innovation, and a recommendation for the appointment of two Professors Emeritus (names embargoed, but they know who they are).

BAD GOVERNANCE UPDATE

Next Wednesday’s Senate meeting will be, if the Chief Administrative Officer has her way, its final one as one of our two senior governing bodies, alongside the Council. Major proposals to amend our Charter, Statutes and Ordinances, originally proposed in February but deferred to May, following a refreshing lack of willingness by our senators to roll over when asked, are to be re-presented next week.

The changes clarify the relative powers of the Council and the Senate – and henceforth the Senate will very much be the junior partner. Here’s a summary:

– The Chancellor will no longer be the ‘Head of the University’, just a person who is able to confer degrees.

– The Court is abolished (see subtext 172). The proposed ‘Annual Public Meeting’ does not get any mention in our Statutes.

– The Council can establish and disestablish colleges, faculties and departments, without having to act on a recommendation of the Senate. It must take the Senate’s views into account, but it may overrule them.

– The Council no longer requires the concurrence of the Senate to amend the Statutes and Ordinances.

– The Senate no longer has a role in appointing the Vice-Chancellor. Previously the VC was appointed by the Council on the recommendation of a joint subcommittee of the Senate and the Council; now the decision will be made by the Council alone.

– The Council will no longer include representatives of the non-academic staff or Lancaster City Council.

Well at least we now know where we stand. Or sit. subtext readers concerned at this total power grab are advised to lobby their Head of Department accordingly.

As noted, the latest set of statute changes will remove the representatives of non-academic staff and Lancaster City Council from the University Council. This seems to have been accepted rather meekly by the parties concerned; in the case of Lancaster City Council, their last representative, Cllr Andrew Warriner, had a decidedly poor attendance record, so perhaps the city council felt it didn’t have much of a leg to stand on. But, formally, the positions remain until the Privy Council amends our statutes.

Anyone examining the current list of Council members on the Secretariat’s webpage wouldn’t know this, however, since it contains no mention of the soon-to-be-abolished positions at all! Jumping the gun? Or accepting the inevitable?

JUST A LIDDLE LONGER

Actually, looking at the list of Council members, subtext noticed something interesting. The five-year term of office of our Pro-Chancellor (aka the Chair of Council), Lord Liddle, had been due to expire on 31 July 2018. Would he face any difficulties in securing a second five-year term of office (see subtext 165)? Well, now his term of office is listed as ending on 31 July 2020! What’s happened here? Has Lord Liddle struck a Granita-style deal with former security supremo Baroness Neville-Jones, our ambitious Deputy Pro-Chancellor, whose term of office is up on 31 July 2020? To be honest, we’ve no idea. Any Council members interested in serving as a mole for subtext should contact us at the usual address.

EDITORIAL

It must be hard, being a Vice-Chancellor. Apart from the hundreds of thousands of pounds you earn, the chauffeur-driven Jaguar, oh, and the pornstar martinis of course, there don’t seem to be many positives to the job.

Everyone’s always complaining at you. Staff who want fair pensions. Students who complain when they aren’t being taught, and want their money back. Deans who complain when their HoDs refuse to do what they’re told to keep striking staff in line… And to top it all off, there’s the union members who complain when you don’t come and visit them for 9 days on the picket lines, and then complain afterwards that you haven’t really said anything. Even when you throw them a bone by agreeing to spread out their payments over three months, they still complain because you’ve told them you don’t think they’ve sufficiently considered the financial impact of striking. Fortunately you’re confident that, like you, they don’t understand all the complicated actuarial science behind their pension schemes, so you’re sure they’ll come round eventually if you just keep repeating that line!

And also, you’ve taken some steps to make sure that any dissenting voices won’t have much opportunity to make themselves heard. You’ve destroyed Court, clipped Senate’s wings, and Council is hardly going to cause you much trouble, given the present membership.

And of course you would never stoop to such questionable ‘leadership’ tactics as Glasgow’s VC, who was out on the picket lines from near the start of the strike, or Kent’s, who issued a joint statement with the local union branch. Or Leicester’s, who is only deducting two days worth of pay per month for the strike action, so the financial loss is spread out over seven months. What a wimp!

Nor would you wish to align yourself with the dozens of VCs who publicly called for a return to negotiations – no, when some nasty journos wrongly reported that you had, you made sure to tell people what’s what. And coming right out and saying we should retain defined benefits, like the Cambridge VC – madness! After all, someone in as important a position as chair of UCEA had better watch out, and stay on the good side of his UUK buddies. Yes, that’s what real leadership looks like!

STRIKE UP YOUR LIFE

In the fortnight since the last edition of subtext, there has been a considerable amount of strike-related activity, both in Lancaster and at the national level.

THE LOCAL FLAVOUR

The campus picket lines have been busier than ever, with a head count of over 160 on Tuesday this week, along with music and dancing every day (Zumba being particularly popular) and even some protest poetry on Wednesday. The VC ‘visited’ on the 8th March, but received a markedly less positive reaction than the several HoDs who did their stint on the lines. Compared to previous disputes, the staff on strike are spread across the whole range of departments in the University, with somewhat less representation from LUMS. Meanwhile, the teach out events, featuring everything from a personal history of the 84/85 miners’ strike to yoga, have also been well attended – see below.

Numerous colleagues involved in the strike have remarked what a sense of solidarity and community is emerging from being thrown together in these adverse circumstances, while the lack of day-to-day work schedules seems to have unleashed all kinds of creativity and willingness to engage in activities that we never normally have time for. Union members were particularly heartened by the strong support from students, some of whom have been coming to the picket lines and teach outs every day.

STRUCK DOWN IN ANGER

At the national level, the past few weeks have seen a flurry of activity. Universities UK (UUK) initially refused to negotiate with UCU, then agreed to meet but not reopen the decision on the pensions proposal (raising questions about what exactly they were proposing to discuss). When one VC after another came out publicly in favour of open negotiations, UUK were eventually forced into a humiliating climbdown and agreed to talks without preconditions at ACAS.

Following a few quiet days last week, and then an announcement that negotiators would be working through the weekend, Monday evening saw the announcement of a so-called agreement between UCU and UUK. This represented an improvement of sorts on the original UUK proposal, but included a worse accrual rate (1/85th of salary for each year of service vs the current 1/75th), an increase in both employee and employer contributions, and a cap of 2.5% on the rate that pensions could increase annually with inflation, meaning that if prices rise by more than this amount, pensions would lose value in real terms.

The reaction from UCU members was… not good. Very quickly, UCU Twitterati took the proposal apart, and an open letter in opposition to the proposal had collected around 3000 signatures by midnight on Monday, while a further 4000 signed by 11am the following morning.

Above all else, members were incensed by the proposal that teaching that had not taken place as a result of strike action should be rearranged. Colleagues argued that this would effectively mean doing work they had already sacrificed pay for. And in any case, there was not nearly enough time to fit 14 days’ worth of teaching into the few remaining days of term.

Throughout Tuesday, members of the union’s Higher Education Committee were subject to a frenzy of social media and email lobbying, overwhelmingly urging rejection. A meeting of branch delegates from all over the country decided almost unanimously to reject what they felt represented a betrayal of the sacrifice that members had made by being on strike.

In the end, the reject camp prevailed, perhaps helped by the large demonstration outside UCU headquarters in London, whose chants could be heard by the delegates arguing inside. The UCU general secretary, Sally Hunt, later explained that the negotiators had been tightly constrained by the ACAS process in what and how they were allowed to communicate.

So the strike continues today and tomorrow, with the fourteen further strike days set to hit assessment season, with exam marking and exam boards likely to be a particular target for local branches. This will undoubtedly have a bigger impact on students than just missing a few lectures, possibly even delaying graduations for final-years. Action short of a strike also continues: UCU members are ‘threatening’ to only do the work they are contracted to do, rather than contributing the massive amounts of unpaid overtime that normally keep universities going on a day-to-day basis.

UUK are blaming the dire situation on UCU for walking away from negotiations, while UCU’s line is that the employers could stop the strike at any point by making a fair offer. Students at Lancaster, for now, seem to be largely supportive of their local staff, though whether this solidarity will continue for a further 14 days of disruption remains to be seen.

TAUGHTILLA

As reported in subtext 174, UCU have been running a series of ‘teach out’ events during the strike – a different way of engaging with staff and students and anyone else who is interested in what the industrial action is about, as well as a number of other somewhat related topics.

While teach outs resemble the form of the labour that staff have withdrawn from their employer, the sessions do not necessarily follow the expected conventions of university teaching. The inherent radicalism of such a venture comes from the enforced interdisciplinarity of the project: colleagues, students and members of the public may come from any academic background, or not be involved in academia at all. It is teaching for interest’s sake, not for ‘knowledge-transfer’, measuring, testing, or satisfying government ‘key information sets’.

Lancaster UCU, together with a host of other branches, organised an alternative education experience for every day of the strike action. Most of the sessions took place at the Gregson Community Centre and were largely well attended, with many packing the Gregson Centre’s modestly-sized hall to the rafters. The curriculum features a mixture of debates, interactive workshops, informal lectures featuring some outside speakers as well as Lancaster academics, film showings, a couple of musical gigs and away from the Gregson some ‘walk and talk’ happenings. In the final days of the current round of strike action, sessions with a more restorative agenda were planned i.e. yoga and craft making.

All the sessions were open to University staff, students, and other folk from the wider community. There was a strong student presence at some sessions and even some members of the public at some events. However, it was staff from the University that made up the bulk of the attendees.

Many of the sessions focussed on the question: ‘what kind of university do we want?’ Yes, pensions were discussed, but within a wider understanding of the changing nature of the sector. Attendees remarked that they felt particularly empowered by speaking with other members of the University who they would not normally meet at work. This prompted a lot of talk about the future and how the this strong feeling of solidarity could be maintained after the dispute.

Readers may have ideas on how this ‘new space’ that the striking community has built can be maintained, and what its purpose would be once work resumes. subtext would welcome contributions on this fascinating development at Lancaster, and would be happy to play a part in future conversations.

RADICAL OR MERELY YOUNGER? A REVIEW

It seems appropriate that on Monday 12 March, midway through Lancaster’s longest period of industrial action in decades, UCU’s teach out at the Gregson played host to an event that seemed to shout, ‘Call that radical? Ha!’ Marion McClintock, Honorary University Archivist and former Academic Registrar at Lancaster, and Alison Lloyd Williams of Global Link’s Documenting Dissent project were our guides as they took us through Lancaster’s radical past, both on and off campus.

According to Mrs McClintock, Lancaster University in its early days was characterised by very conservative Heads of Department, many of whom were ex-military, alongside younger, more radical staff, who pioneered Lancaster’s distinctive degree programmes: Religious Studies (not Theology), Independent Studies, Creative Writing, Environmental Studies, Peace Studies, Marketing, and Systems Engineering. Students were given the chance to ‘grapple with subjects they’d not studied before.’ Above all, Lancaster was shaped by its first Vice-Chancellor, Charles Carter, who actively encouraged this interdisciplinary approach. We were a university that ‘was taking a fresh look at society, was taking nothing for granted and was questioning norms.’

Publications of the time, like John O’Gauntlet and Carolynne, reflected this mood and encouraged debate on drugs, sex and gay rights, although some of their editorial choices, such as pin-up girls in Carolynne, seem archaic today.

Among the many disputes of the early years were ‘the mixed bedrooms argument of 1968’, the David Craig affair (see subtexts 8 and 9) and the 1975 rent strike which lasted over 12 months. Student involvement in these disputes was strong.

Lancaster’s college system played an important role in Lancaster’s free-thinking tradition; Sir Noel Hall, one of the university’s founders, was formerly Principal of Brasenose College, Oxford and had insisted that the colleges must form an integral part of Lancaster’s governance.

Why are things not like that any more? Lancaster’s rising research reputation in the 1980s meant that staff and students no longer had as much time to spend on innovative teaching or political discussion, and even Prof Carter was subject to the same pressures as everyone else.

Ms Lloyd Williams gave a history of the Documenting Dissent project, which was inspired by Lancaster Castle and its status as a symbol of state power and the location of Lancashire’s most important court. Many dissenters, including several chartists, had been tried there.

Lancaster is particularly significant in LGBT history, given the number of people prosecuted for homosexuality at the Castle, but more happily due to the significant presence during the 1970s of the Gay Liberation Front (GLF) on campus, and the Campaign for Homosexual Equality (CHE) in town. Lancaster University pioneered women’s studies and radical feminism, while the very first CHE Conference took place in Morecambe.

More recently, the case of the George Fox Six, where six students and ex-students disrupted a conference in George Fox Lecture Theatre 1 and were promptly prosecuted for aggravated trespass, shows both that the dissenting tradition is still there … but that the university is no longer as tolerant as it was. The Documenting Dissent website includes an account of the affair, including an interview with Matthew Wilson, one of the six.

Contributions from the floor included comments from several people who have been encouraging the radical tradition at Lancaster for decades, including city councillor Andrew Kay, who remembered long campus debates on ‘this house will not give a platform for racist and fascist speakers’ and ‘this house is glad to be gay’, and former city councillor Tony Pinkney, who thought two years stood out in particular – 1886, when William Morris’s talk in the town led to the founding of the Socialist League, and 1999, when Lancaster elected its first ever group of Green Party councillors.

DEMOCRACY IS THRIVING … ELSEWHERE

There have been many Vice-Chancellorial U-turns on USS and risk recently, but the most notable ones have come from the VCs at Oxford and Cambridge, both on 7 March. Given that the colleges of Oxford and Cambridge were all treated as separate institutions in Universities UK’s September 2017 survey of attitudes to institutional risk, this is a major shift.

Why the change? Of course, we are happy to accept that both VCs will have reached their decisions sincerely. But Oxford’s VC, Prof Richardson, has probably been helped by the meeting of Oxford’s Congregation on 6 March, at which a resolution seeking to overturn Oxford’s existing stance on pensions was first blocked controversially, and then discussed outside, where it passed 442 to 2.

Likewise, Cambridge’s VC, Prof Toope, doubtless had his mind sharpened by the impending ballot of Cambridge’s Regent House, on a motion submitted by 501 members, which seeks to amend Cambridge’s official view on USS.

For readers not familiar with how Oxford and Cambridge work, the Oxford Congregation and Cambridge Regent House are the supreme governing bodies of those institutions, made up of all academic staff. They can, and occasionally do, overrule the University Council.

True democracy in action! But wait. Surely these forms of governance must violate the Committee of University Chairs’ Higher Education Code of Governance, the document which our Chief Administrative Officer in particular is very fond of (see subtext 174 and other subtexts passim)?

Well … yes. But they seem to be doing OK, all things considered.

Now that our Court has met for the final time, and our Senate has willingly handed its power to amend statutes over to our Council, perhaps we should start advocating something similar here? After all, our VC’s usual answer when challenged about centralising power is ‘the Warwick clincher’ – they do it at Warwick so it must therefore be a good thing – so perhaps we should start playing ‘the Oxford gambit’ in response.

Dear subtext,

This week our VC wrote to tell us that Lancaster would have supported the ACAS deal. But it is also true Lancaster would have supported the original UUK/USS proposal (perhaps reluctantly) which amounted to little less than criminal theft of our pensions.

This week our VC also wrote thanking those staff who have carried on working through the strike. I would also like to thank the strikers for having the courage to stand up for what is right. They are making sacrifices in order to protect the common good. They are striking because they care about Lancaster University, its students and the quality of education. Throughout the strike we have carried on teaching and learning at events in the city; this has not stopped. And any gains we make against the theft of our pension will benefit every USS member, not just those who are taking action.

The ACAS deal this week appeared at first sight to some to claw back some of what was being stolen from us. They would steal a little less. But we would pay a heavy price for that and end up all the weaker. It was firmly rejected because it too would signal the end of what we still have now – a mutualised scheme. And that is also why strikers are standing out there on the picket line every morning – because they don’t want to work in a glossy private corporation, they want to work in a university where education is seen as a public good for mutual benefit.

UUK’s position and governance processes are now exposed as a sham and are discredited. University leaders, students and even the financial press are calling for a rethink of the whole process and valuation methods. It seems no one can publicly defend the unethical practices which led up to the UUK’s decision to insist on ending defined benefits. An official complaint has been made about USS governance to the Charity Commission and there is now a crowdfunding initiative to sue the USS trustees. But we can’t give away our pension while the rethink takes place. Everyone will then lose.

So if you are a member of USS and you haven’t yet joined the action, join us for a warm welcome, and you can join UCU immediately. This will shorten the dispute and help us all do what we want – get back to work.

Apropos Bob Jessop’s ‘seven crane vice chancellors’ (subtext 174), some time in the 1990s I paid my annual external examiner’s visit to an MA exam board at an institution on the outskirts of Greater London – naming no names. The course – innovative, if not radical, and with a terrific track record in attracting and supporting non-traditional students – had been in the university’s sights for some time, partly for just those reasons but also because several of the staff had had the cheek to object to various managerial ploys. I arrived just after the startled chair of the board had received a phone call from the Vice Chancellor’s office, to say that the VC was planning to turn up in a few minutes, to exercise his statutory right to attend any exam board in the university (not one of his regular habits). We decided that this must be intended to intimidate me, since the internal examiners were well beyond intimidation. A kindly staff member said to me ‘I find it helps if you remember that all VCs are property spivs. Some are developers, some are speculators. Ours is a speculator. What’s yours?’ Since this was in the days of the blessed Bill Ritchie, I was slightly at a loss to answer, but I found the advice helpful, and persisted in writing a glowing report despite the menacing charm with which the speculator took me aside after the meeting and invited me to ‘tell the truth’.

The Grand Theatre presents shows which aim to attract audiences from all walks of life. As a charity funded largely by ticket sales we aim to complement the subsidised Dukes Theatre in our programming and attract as wide an audience as possible. In the last edition of subtext your cultural correspondent in his review of the Dave Spikey show at the Grand invited readers to prove him wrong regarding his observation that he was the only member of the audience employed by the University. I was there on row C (that’s the second row for those unfamiliar with The Grand’s unusual seating plan) – a thorn between two retired/semi-retired colleagues. I’m sure there were others, although I will admit that I didn’t see any others from Uni, despite having plenty of time to look during the slexit (slow exit).

EDITORIAL

Five days down, nine days of strike action to go (unless one side blinks today or tomorrow). It’s time for our Vice-Chancellor to state a consistent position, publicly, on the future of USS.

As subtext revealed in a newsflash last week, Prof Smith denied in Senate that – as reported in the Times that day – he’d broken ranks with the majority of Vice-Chancellors and supported a change to Universities UK’s current policy on USS. Apparently the sides are too far apart and we couldn’t afford UCU’s demands anyway.

Meanwhile, Prof Smith’s statements to staff meetings over the past few months have been broadly supportive of retaining a defined benefit scheme, and many staff had been heartened to read that ‘Mark’s on our side’ last Wednesday. Some may have decided at the last minute not to take strike action, in the belief that Prof Smith was one of the good guys and gals within UUK who deserved support.

So was the Times’s story just fake news? Or has our Vice-Chancellor been giving different messages to different audiences?

A string of Vice-Chancellors made public declarations of support for a change to Universities UK’s pensions policy in the last week, with one (Glasgow Principal Anton Muscatelli) even joining striking staff on the picket line . Now might be a good time for Prof Smith to side with the staff at his own institution …

… or not, if his statement to the Senate is a truer reflection of his thinking. If so, then he should say this openly – at least we’d know where he really stands.

SENATE SKETCHES

PLUNDERING THE PENSION

The VC opened his report with some good news. Applications are up, including a 9% increase from EU countries, while the sector average is down. Research grant income continues to be strong. Work has at last started on the new £41M Health Innovation Campus. Now for the not-so-good news. The level of university fees was now being questioned by the government (yes, that same government that increased them to over £9K in the first place). This was not good for universities, and while students might raise the odd cheer, the VC was scathing, especially about Lord Adonis’ suggestion that fees be pegged at £6K.

The big issue was the pensions dispute. The VC gave a succinct account of the recent history of USS pensions, showing how the various changes over the last few years had steadily reduced their value. There was a dispute about the size of the scheme’s current ‘deficit’ but he had thought that an agreement was close until the intervention of the Pensions Regulator. This, he believed, was political. The Regulator had been publicly lacerated over its laxity in the BHS and Capita pensions scandals and needed to show that it was on the case with USS. (Of course, an alternative interpretation might be that, as with Carillion, the Regulator was only too willing to support the employers’ interest). So this was how we got to where we are now.

At this point Senators might be forgiven if they thought that the VC was about to announce that he would be joining the picket lines himself the next day. Alas, this was not to be the case. When asked if he would be supporting LUSU’s and other Vice-Chancellors’ calls for an immediate return to national negotiations, he said emphatically that he would not. He denied the report in that day’s Times that he had joined ten other VCs in calling for a resumption of negotiations. The two sides were too far apart – he used the word ‘chasm’ – and as such there would be nothing to negotiate about. Besides, Lancaster could not afford the UCU demand for a 2% increase in the employer contribution to the pension fund. It would cut into our annual surplus, and everyone knows that our surplus is for Spine embellishments, football universities, and golf courses, not for frittering away on staff. Was there any chance of students’ getting any compensation for lost contact time, as is their right as consumers? Hardly! What about the strikers’ pay deductions? Would the money the university saved be donated to the student hardship funds, as had happened with previous strikes? Yes, of course, but only after certain university expenses had been covered. And what were these? Why, the cost of providing pensions advice to staff who would have to grapple with the complexities of a new defined contributions scheme. You can’t say that our VC doesn’t think ahead.

ALL POWER TO THE COUNCIL!

The big agenda item for the day was a raft of constitutional changes for Senate to approve. The Chief Administrative Officer opened by stating that the proposed changes followed from the recent Council Effectiveness Review and the abolition of Court, and it was largely a tidying up operation. She would not go through these in detail as she presumed that everyone had read the papers. It soon became clear that most Senators had not read the papers. Some had, though, and the claim enshrined in the proposals that Council was ‘the supreme governing body and final decision-maker’ was challenged. According to the CAO, this was required by the Code of Practice that all university governing bodies had to observe. Not so, said some Senators, with one reading aloud what the Code actually stated. To which the CAO responded with an irrefutable alternative fact – that this is what the new Office for Students might in the future require us to do. Senate seemed happy to accept this line of reasoning. One Senator seemed particularly troubled by the proposal to give Council the sole authority to make and amend Statutes and Ordinances, ‘Henry the Eighth powers’, as he called them. Against this the VC deployed his ultimate debating weapon – the Warwick Clincher. His old employer had done this, therefore so should Lancaster. Senate duly voted in favour. However, there was by now enough disquiet about the future position of Senate in terms of academic governance that the rest of the proposed changes were withdrawn for further working. But the VC had achieved what he wanted – Council now had the sole right to make, change and remove Statutes. Lancaster can now look forward to having a much smaller Senate – just like they have at Warwick, where they don’t have colleges.

BEST OF THE REST

The Dean of LUMS presented the formal proposal to close the Department of Leadership and Management, and split its activities between the departments of Organisation, Work and Technology, and Entrepreneurship, Strategy and Innovation. It would seem that the process to bring this about was a model of best practice, with a ‘consultative approach’ throughout ‘the project’, ‘clear communication given to staff’, and ‘consistent’ involvement with the unions. For what really happened, see subtext 169.

A proposal from the PVC (Education) for the establishment of an ‘Institute for the Enhancement of Learning and Teaching’ (InELT) was warmly received, its safe passage ensured by the promise that it wasn’t going to cost any money. However, it was felt that the acronym was insufficiently cumbersome for a Lancaster University institute so it was agreed that ‘curriculum’ should be inserted somewhere in its title. Perhaps it could be called something like ‘CELT’. Now that name rings a bell…

Finally, a paper from PPR and the Deputy VC for the establishment of an ‘Interdisciplinary Research Centre focused on China’. Now this one would cost money, so the paper was a testing of the waters rather than a definite proposal. Senate rather liked the idea, and agreed that the sponsors should go ahead with putting together a more detailed proposal.

LU TEXT LOST AND FOUND

Those who follow us on Facebook (facebook.com/LUSubtext – you really should ‘like us’, we occasionally update the page and everything!) will have seen our latest takedown of the fake news media.

This time the culprit was the Times, which had the temerity to suggest that our Vice-Chancellor would be so fiscally reckless as to support further negotiations between UCU and UUK. As we noted on Facebook, the VC vehemently denied these claims at a subsequent meeting of the Senate, deeming UCU’s demands too expensive for the university to afford. PREVARICATION NEWSFLASH

On the eve of pensions strike, Lancaster UCU members were cheered by a report in that day’s Times that VC Mark Smith had joined ten other university leaders in calling for a return to national negotiations. This represented a fundamental change in his position but, alas, it proved to be fake news. A couple of hours later he was asked about his change of heart and he denied the story emphatically. He did not see any value in calling for a resumption of talks because the two sides were too far apart. And anyway, Lancaster could not afford what UCU was asking for.

CLOD-HOPPING HOD-DROPPING

As the muted rows about the new processes for appointing heads of academic departments rumble on, it is worth reflecting on just how fundamental those changes are. The traditional Lancaster approach was, broadly, to allow departments to devise their own procedures, with the expectation that at some point all senior members should take their turn at the helm. The new process, which follows on from last year’s HoD Review, introduces two new features: that the HoD should ‘normally’ be a professor (if necessary, an external one), and that final approval of the candidate is to be made, not by the department or the faculty, but by a central appointments panel chaired by the VC.

While Lancaster is second to none when it comes to the quality of its professoriate, it does not follow that exemplary scholarship brings with it the skills and understanding required to run an academic department. (Why, we know of some professors… but that’s another story). There is also an equalities issue to consider. Currently, there are 295 professors in the university, of whom 69 (23%+) are women. However, the academic workforce is 36% female, so there is more chance that a professor will be a male. It follows that if the opportunity to head a department is restricted to an unrepresentative professoriate, there is indirect discrimination against women academics.

The situation becomes more worrying when one considers the composition of the HoD Appointments Panel. In a recent case, the panel included the Chief Administrative Officer and the HR Director. They were not there ‘in attendance’, but as fully-participating panel members. This is unprecedented. Never in the past have senior administrative officers had a direct say in academic appointments. There is the argument that a departmental headship is a management post, not an academic one. If that is the case, then there should not be a requirement that the holder be a professor, an academic title. The role of the HR Director in the process is particularly problematic. HR has the responsibility for monitoring and reporting on compliance with the University’s diversity and equality policy. If a complaint of discrimination should arise, who could be confident of the impartiality of an HR investigation if the boss was directly involved in making the decision? Finally, there appear to be no arrangements for oversight, as there are with other appointing bodies. Is the VC to report to himself?

BRAVE NEW WORLD

Obviously inspired by subtext’s recent embracing of technology, the Vice Chancellor has decided to bring his particular badinage of vernacular to Twitter, and you can follow him at: twitter.com/VCMarkESmith

Amongst pictures of him mingling at conferences, praising speakers and announcing his speaking engagements, we noted that the VC recently retweeted a WonkHE columnist’s list of the ‘dumbest university rankings’, which included the Spiked Online ‘Free Speech’ league table and the People and Planet’s green ratings as its top two. Neither of which Lancaster does particularly well in, but to be fair they are both admittedly dumb tables – what causes us to pause for thought is how the VC feels about some of the other ‘dumb’ rankings we’ve received that have featured prominently in the University’s marketing.

THE THIRD RED SCARE

Regular readers of one of subtext’s minor competitors, The Guardian, may have come across an article early on Tuesday morning about a letter sent by Tory whip Chris Heaton-Harris to University Vice-Chancellors demanding to know who was teaching students about Brexit, and what the content of their courses was as well as links to online lectures (http://tinyurl.com/yd7e5xqe). It is true that subtext’s coverage of VCs does not always consist of glowing praise, given pay differentials, inaction on pension theft, vanity building projects, and a litany of other charges. But it seems that at least one VC, Worcester top dog David Green, comes off as something of a hero in this tale, by more or less intimating that he intended to tell the MP to chuff off. Whether our VC had a similar response in mind has yet to be established – D floor has not yet responded to subtext’s request for a comment – though according to the Guardian (the local paper, that is, not the national one – keep up!) it was being treated under the University’s Freedom of Information procedures. This, of course, could amount to the same thing.

Meanwhile, back to Heaton-Harris’s shenanigans, around Tuesday lunchtime, by a report that Downing Street had issued a statement saying Heaton-Harris had been acting not as a Government whip, but in a personal capacity as an MP (http://tinyurl.com/ycdgf4vk). That man must have some interesting conversations with himself. In future, he might take the time to have a good chat with himself about who actually teaches at university, as his letter asked for details of ‘professors’ teaching in the area – presumably unaware of the fact that in the UK, professors mostly do what they can to avoid teaching, which is largely carried out by more junior staff. Or perhaps he thinks anyone who is not a professor can’t be taken seriously? Given the leave campaigners’ attitudes towards ‘experts’, we rather doubt the latter could be the case. Heaton-Harris has been the recipient of failed Tory leadership candidate Andrea Leadsom’s full support, so it can only be a matter of time before he is sacked.

A number of other newspapers have jumped on Heaton-Harris-bashing bandwagon since Tuesday, while some of their… less salubrious fellow publications have jumped to his defence, with hand-wringing articles mentioning ‘remainer universities’ and ‘fears students are being brainwashed by remain-supporting lecturers’. You’d almost think universities had some vested interest in EU membership, such as depending on millions pounds of EU project funding, partnerships with other European universities for inbound and outgoing exchange programmes, and being able to recruit thousands of highly qualified staff from other EU countries.
